El proceso como sistema en el estado de derecho/The lawsuit as a system in the state of legal rights

Resumen

La observación de la diversidad de instituciones y sistemas a través de los cuales se administra justicia en los Estados modernos, abre un campo inmenso y sorprendente. La gama de la diversidad es de tal magnitud que elude una expresión en términos de vocabulario común y nos hace sentir inseguros acerca de nuestros puntos de referencias básicos. ¿Requiere el proceso legal, como se cree a veces, la interacción de tres partes independientes –un demandante, un demandado y un juez- o puede tomar la forma de un affaire á deux entre un individuo y un representante del Estado? ¿Cuáles son las funciones y los atributos esenciales de este funcionario? ¿Es básicamente una persona que resuelve conflictos, el que aplica la política del Estado?...¿cuáles son los requisitos mínimos en los Estados de Derecho modernos para un debido proceso? Estas y otros interrogantes, o las múltiples respuestas que ofrecen los sistemas modernos, piden explicaciones”

ABSTRACT

The observation of the diverse institutions and systems through which justice is served in the modern states, opens an immense and surprising field.  The extent of this diversity is of such magnitude that it evades an expression with common vocabulary and it makes us feel insecure about our basic references. Does the legal process, as it is sometimes believed, the interaction of three independent parts – a plaintiff, a defendant and a judge – or can it take the form of an affaire á deux between an individual an a state representative? Which are the functions and essential attributes of this state representative? Is it basically a person who resolves conflicts, the one that applies state policies? Which are the minimum requisites in the modern state of legal rights for a due lawsuit? These and other questions, or the multiple answers that modern systems offer, request enlightenment.
