Los procesos colectivos en Argentina/Collective protection at Argentina

Resumen

Se analiza los principales ejes comunes de los procesos colectivos, concernientes a: los intereses protegidos; la legitimación activa y; la cosa juzgada. Se concluye que, en el sistema jurídico argentino, los procesos colectivos procuran la tutela de derechos de incidencia colectiva, no sólo sobre bienes colectivos, sino también, sobre bienes individuales homogéneos. La presencia, en un caso concreto, de un derecho de incidencia colectiva, trasciende al plano de los efectos, principalmente, en lo atinente a la legitimación y la cosa juzgada. Por un lado, se extiende el universo de sujeto legitimados –de modo extraordinario-, hacia el afectado, las asociaciones, el Defensor del Pueblo y el Ministerio Público. Por otro lado, impacta en diversos aspectos de la sentencia: necesariamente, extendiendo los límites subjetivos de la cosa juzgada y, eventualmente, facultando al Tribunal para dictar resoluciones de tipo “exhortativas”, de acuerdo a las circunstancias del caso concreto.

ABSTRACT

The following paper analyzes the main common issues of collective protection, concerns to: the interested protected; the legal standing; and the res iudicata. We conclude that the Argentine legal system, collective processes seek guardianship of collective rights, not only on collective goods, but also on individual homogeneous goods. The presence in a particular case, the right to collective impact transcends the plane of effects, mainly as it pertains to standing and res judicata. On the one hand, expand the universe of legitimate subject-extraordinary-mode, to the affected, associations, the Ombudsman and the Public Ministry. On the other hand, impacts on various aspects of the judicial decision: necessarily, extending the subjective limits of res judicata and, eventually enabling the Court to take exhortative decisions according to the circumstances of the case.
