Resumen

Se analiza el rol que le cabe al Magistrado en la creación del Derecho, a la luz del cambio de la Constitución Nacional de corte liberal a una de claras condiciones sociales, que no constituye producir únicamente sentencias, sino reformular el aforismo romano de "dura lex, sed lex".

ABSTRACT

The role of the magistrate is analyzed in the creation of the Law, in the light of the change of the National Constitution from a liberal one to one of clear social outlook, which does not solely constitute the production of sentences, but the reformulation of the Roman aphorism “dura lex, sed lex”.
